Happy Delivery LLC (“Happy Delivery,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit our website at happydelivery.com (the “Site”), apply for employment with us, work for us as a delivery associate, or otherwise interact with us, including by SMS text message.
1. Information We Collect
We collect the following categories of personal information:

  • Contact information: name, mailing address, email address, and mobile telephone number.

  • Application information: resume, work history, references, eligibility-to-work documentation, and other information you provide when applying for employment.

  • Employment information: payroll data, tax forms, performance and safety records, vehicle and route assignments, and other records related to your employment with Happy Delivery (collected only after hire).

  • SMS interaction data: the content of SMS messages you send us, timestamps, delivery status, and opt-in/opt-out records.

  • Website usage data: IP address, browser type, pages viewed, and similar technical information collected automatically when you visit the Site.

2. How We Use Your Information
We use personal information to:

  • Evaluate job applications and communicate with applicants about the hiring process.

  • Onboard, manage, schedule, dispatch, pay, and otherwise administer the employment of delivery associates.

  • Send operational SMS messages, including shift confirmations, route assignments, schedule changes, dispatch alerts, safety and policy updates, interview scheduling, application status, and onboarding notifications.

  • Comply with legal, tax, employment, and Department of Transportation recordkeeping obligations.

  • Operate, maintain, and improve our Site and services.

3. SMS Messaging Program
Happy Delivery operates an SMS program for job applicants and current delivery associates. By providing your mobile phone number through our online job application or during employment onboarding, and affirmatively consenting via checkbox or signed consent form, you agree to receive SMS messages from Happy Delivery related to your application or employment.
Message frequency varies based on your role and shift schedule. Message and data rates may apply. You may opt out at any time by replying STOP to any message. You may request help by replying HELP, or by contacting us using the information at the end of this Policy. Opting out of SMS does not affect your application status or employment standing, but may limit our ability to communicate operational information promptly.
We do not share, sell, rent, or transfer mobile phone numbers, SMS opt-in data, or SMS message content to any third party for the third party’s own marketing or promotional purposes. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All categories above exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
4. How We Share Information
We share personal information only as needed to operate our business and only with parties that are contractually obligated to protect it. Categories of recipients include:

  • Service providers that help us operate (e.g., applicant tracking systems, payroll processors, SMS delivery providers such as Twilio, scheduling tools, HR information systems).

  • Amazon.com Services LLC and its affiliates, in connection with our role as an Amazon Delivery Service Partner, where required for route assignment, station access, safety reporting, or compliance.

  • Government agencies, regulators, and law enforcement, where required by law or legal process.

  • Professional advisors (attorneys, accountants, insurers) under confidentiality obligations.

We do not sell personal information.
5. Data Retention
We retain personal information for as long as needed to fulfill the purposes described in this Policy, to comply with legal and regulatory obligations (including DOT, IRS, and state employment recordkeeping requirements), and to resolve disputes. Applicant data for non-hired candidates is typically retained for two years; employee records are retained for the duration of employment plus the period required by applicable law.
6. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, and destruction. No system is perfectly secure, and we cannot guarantee absolute security.
7. Your Rights
Depending on your state of residence, you may have the right to request access to, correction of, or deletion of personal information we hold about you, and to opt out of certain processing activities. To exercise any of these rights, contact us using the information below. We will respond consistent with applicable law.
8. Children’s Privacy
Our services are not directed to individuals under 18, and we do not knowingly collect personal information from minors.
